Governor Ritter recently signed legislation (effective May 29, 2008) obligating all jurisdictions governing development in Colorado to require proof of adequate water supply for proposed development.  The legislation, House Bill 08-1141 has relatively strict requirements for a Water Supply Report to be submitted to a governing body.  It also requires the Report to be submitted by a Water Supply Expert or Professional Engineer.  According to the Bill, a local government shall not approve an application for a development, unless it determined that the proposed water supply will be adequate.  Jehn Water Consultants, Inc. has provided these Water Supply Reports to governing agencies and has provided review services of these Reports for many clients in Colorado.  The highlights of the bill include:

  • Determining the water supply requirements for the proposed development;
  • Investigating and understanding the physical source of the water supply;
  • Determining the water yield of the supply;
  • Water conservation measures that may be implemented;
  • Water demand management measures;
